Bobyard, Inc. ("Bobyard," "we," "our," or "us") provides AI-powered estimation and measurement software for the construction industry. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our public marketing website at bobyard.com (the "Site"), submit a demo or sample-run request, or use our authenticated product platform (collectively, the "Services").

Please read this policy carefully. By accessing the Site and using the Services, you agree to the practices described here. If you do not agree, please discontinue use of the Site and or Services.

Information We Collect

1.1 Information You Provide Directly

We collect information you voluntarily submit to us through public request forms or through authorized product accounts, including:

Demo request form: name, email address, trade/industry, headquarter state, and scheduling preferences (routed through HubSpot and Calendly).
Sample-run form: name, email address, phone number, company name, trade, and an uploaded construction plan file.
Blog subscription: email address.
Support and messaging: communications submitted through Intercom in the authenticated product.
Account registration: name, email address, company information, and login credentials.

1.2 Information Collected Automatically

When you visit our website or use our platform, we and our third-party partners automatically collect certain information, including:

Pageview and navigation data (pages visited, time on page, referral source)
Session and visitor identifiers
Campaign and conversion context (e.g., UTM parameters, ad click identifiers)
Device and browser information (browser type, operating system, IP address)
Authenticated product usage data: account creation events, project and file activity, AI-tool and chatbot usage, measurement activity, and legend events, captured through Mixpanel
Session recordings and behavioral data in the authenticated product, captured through FullStory

Note: Some Global Privacy Control measures and functionality are still in development. Bobyard deliberately removes common advertising and campaign tracking URL parameters (such as UTM and click IDs) from the visible URL on the public marketing website after page load. These identifiers are used solely for internal analytics and are not persistently stored in your browser.

1.3 Information from Third Parties

We may receive other information about you from third-party services, including:

Billing and account information from Stripe for payment processing
CRM and contact enrichment data processed through HubSpot
Scheduling data from Calendly when you book a demo

Uploaded Files

If you submit a sample-run or demo request, you may upload a construction plan file. Uploaded files are stored in AWS/S3-compatible cloud storage. A preassigned URL for the uploaded file is included in our internal notification emails and may be accessed by Bobyard personnel for the purpose of processing your request. Please do not upload files containing sensitive personal information beyond what is necessary for the sample run.

Information We Do Not Intentionally Collect

Our Services are not designed to collect sensitive personal information such as Social Security numbers, government-issued identification numbers, financial account numbers, health information, or biometric data. Please do not submit such information through our Services.

How We Use Your Information

We use the information we collect for the following purposes:

Service Delivery: Providing and operating the Services.
Lead and Sales Operations: Processing demo requests, sample-run submissions, and subscription sign-ups.
Billing and Administration: Billing, invoicing, and account management through Stripe and HubSpot.
Customer Support: Responding to questions, troubleshooting issues, and providing in-product support through Intercom.
Analytics and Product Improvement: Analyzing how users interact with our website and product to improve performance and user experience.
Marketing and Advertising: Understanding which marketing campaigns drive awareness and conversion using Google Analytics and HubSpot.
Debugging and Quality Assurance: Diagnosing bugs and reproducing unexpected behaviors in the authenticated product using FullStory session recordings.
Transactional Communications: Sending confirmation emails and internal notifications relating to sample-run and demo submissions through EmailJS.
AI and Model Improvement: Improving the accuracy, performance, and capabilities of our AI-powered features using aggregated and anonymized usage data (see Section 7).
Legal and Compliance: Fulfilling legal obligations, enforcing our terms of service, and protecting the rights and safety of Bobyard and its users.

AI Features and Subscriber Data in the Platform

Bobyard's platform includes generative AI features that process data you provide in order to perform estimation, measurement, and related tasks on your behalf. This section describes how data interacts with those AI features.

3.1 Processing Your Data To Provide AI Features

When you use AI-powered features in the platform, the inputs you provide (such as uploaded files, measurements, and configurations) are processed by Bobyard's AI systems to generate sample runs, walkthroughs, estimates, takeoffs, and other AI-assisted outputs. This processing is performed solely to deliver the requested functionality.

3.2 Aggregated and Anonymized Data for Product Improvement

Bobyard may use de-identified, aggregated data derived from user interactions with the platform to improve the quality, accuracy, and performance of our AI models and product features. "Aggregated and anonymized" means that the data has been processed to remove any information that could reasonably identify you or your organization and is combined with data from other users such that no individual subscriber's information is discernible.

3.3 Third Party AI Providers

Bobyard may engage third-party AI infrastructure providers to power certain features. Where such providers process personal data, they do so as service providers acting on our instructions under appropriate data processing agreements. We do not permit such providers to use your data for their own model training.

4. Third Party Services and Data Sharing

Bobyard shares data with the following third-party service providers solely to operate the Services. Each provider acts as a service provider or data processor on our behalf and is contractually restricted from using your data for their own independent purposes, except as noted.
